General Terms and Conditions of Sale

Article 1 – Purpose

These General Terms and Conditions of Sale (hereinafter "GTC") govern the sales of products made on the website moumouns.com , operated by Mailys Makane , to consumers, as defined in the preliminary article of the Consumer Code.

Any order placed on the site implies unreserved acceptance of these Terms and Conditions.

Article 2 - Nature of the product

The products offered for sale are those appearing on the moumouns.com website on the day of consultation by the customer.

Each product is accompanied by a description allowing the customer to know its essential characteristics.
The photographs are as accurate as possible but have no contractual value.

Article 4 – Pre-orders

Some products offered on the site may be sold on pre-order .

In this case :

  • The customer pays the full amount of the order at the time of purchase.

  • Shipping takes place as soon as the product is available in stock.

  • The delivery times are given as a guide and may vary in case of unforeseen circumstances.

In case of a significant delay, the customer will be informed by email.

Article 5 – Price

Prices are shown in euros (€) , including all taxes (TTC).

Delivery costs are shown before order confirmation.
In some cases, delivery may be offered.

The seller reserves the right to change its prices at any time, but products are billed based on the rates in effect at the time of the order.

Article 6 – Order

The customer places an order on the website moumouns.com .

The order is considered final after:

  • shopping cart validation

  • acceptance of the terms and conditions,

  • actual payment.

A confirmation email is sent to the customer after the order has been validated.

Article 7 – Payment

Payment is due immediately upon ordering.

The accepted payment methods are those offered on the site at the time of ordering (credit card, PayPal, payment solutions offered by Shopify).

Payments are secured through certified payment systems used by Shopify.

Article 8 – Delivery

8.1 Delivery Method

Orders are shipped via La Poste Tracked Letter , unless otherwise stated.

8.2 Delivery Times

Delivery times are estimated at 2 to 4 working days after dispatch for mainland France.

These delivery times are indicative and may vary depending on the conditions of the Post Office or during periods of high activity.

8.3 Delivery Area

Deliveries are guaranteed:

  • in metropolitan France,

  • and possibly in certain European or international countries depending on the options offered when ordering.

Article 9 – Right of withdrawal

In accordance with Articles L221-18 et seq. of the Consumer Code, the customer has a period of fourteen (14) days from receipt of the product to exercise his right of withdrawal, without having to justify any reason.

The product must be returned in a condition that allows for its resale , that is to say:

  • unused or used only to verify its nature, characteristics and proper functioning,

  • own,

  • in perfect condition

  • in its original packaging.

In the event of depreciation of the product resulting from handling other than that which is necessary , the seller reserves the right to apply a discount or refuse reimbursement , in accordance with Article L221-23 of the Consumer Code.

Article 10 – Returns and Refunds

Beyond the 14-day withdrawal period, no returns or refunds will be accepted , except in the following cases:

  • defective product

  • Product damaged during delivery.

  • The error is attributable to the seller.

Returned products must be:

  • not used

  • clean,

  • complete,

  • in a condition allowing their resale.

Return shipping costs are the responsibility of the customer, except in the case of an error or defect in the product , in which case the costs will be covered by the seller.

The refund will be issued within a maximum of 14 days after receipt and verification of the returned product.

Article 11 – Responsibility

The seller cannot be held responsible for damages resulting from misuse of the purchased product.

The seller's liability is limited to the amount of the order.

Article 12 – Personal Data

The personal data collected is necessary for order processing.
They are processed in accordance with the site's Privacy Policy .

Article 13 – Intellectual Property

All elements present on the moumouns.com website, including stickers, illustrations, drawings, models, visuals, graphic creations, designs, texts and logos , are protected by intellectual property law and are the exclusive property of Mailys Makane , unless otherwise stated.

Any reproduction, representation, modification, distribution or exploitation, in whole or in part, of these elements, without prior written authorization , is strictly prohibited and constitutes an infringement liable to civil and criminal penalties.

Article 14 – Applicable Law and Disputes

These terms and conditions are governed by French law .

In the event of a dispute, the customer is encouraged to contact the seller for an amicable resolution.
